Have You Been Subjected to MLAT Search and Seizure?

Search and seizure issues leading to extradition often arise from joint international investigations under one of the many Mutual Legal Assistance Treaties (MLAT). This is often the first step taken in an extradition proceeding, usually surfacing well in advance of any extradition hearing. An MLAT search and seizure typically occurs after an individual has been investigated by such foreign agencies as the FBI on suspicion of a crime such as telemarketing fraud, I.D. theft, narcotics trafficking or conspiracy. The foreign agency typically seeks the assistance of the RCMP or other Canadian police force to help investigate an alleged cross-border crime. Often the alleged conduct takes place in Canada but is directed toward the residents of another country. That is enough to trigger an MLAT investigation. The person or company being investigated may not be aware of the investigation — or even that such an investigation is possible. Once a person's business or personal assets are seized, often on the basis of suspicion alone, the information may lead to criminal charges in Canada — or, more likely, to extradition.
